New Delhi [India], September 9 (ANI): Delhi’s Rouse Avenue court on Monday remanded AAP MLA Amanatullah Khan in judicial custody in connection with a money laundering case linked to the Delhi Waqf Board till September 23.
He was arrested by the Directorate of Enforcement (ED) on September 2. He has been arrested in connection with the purchase of Rs 36 crore property in Okhla.
Special judge Rakesh Syal remanded Amanatullah Khan in judicial custody till September 23 after hearing submissions of ED and defence counsel.
Advocate Simon Benjamin, Special Public Prosecutor (SPP) for the Enforcement Directorate (ED), sought judicial custody of Amanat Ullah Khan.
He was produced before Rouse Avenue court after expiry of custody remand. ED has interrogated Amanatullah Khan for seven days after his arrest on September 2.
While seeking judicial custody, the ED said that it has already filed a charge sheet against four persons and one entity.
We will file a supplementary charge sheet against the accused, Amanatullah Khan, the SPP said.
It was further submitted that the present accused is the main accused and the investigation is still going on. He may tamper with the evidence if not sent to judicial custody, ED added.
On the other hand, advocate Rajat Bhardwaj, along with Kaustubh Khanna, counsel for accused Amanatullah Khan, moved an application opposing the judicial custody remand.
The accused had appeared before ED on April 18. Data from his phone was submitted on February 9.
It was also submitted that there is nothing new material and there is no justification in seeking judicial custody by the ED.
Advocate Bhardwaj submitted that ED had first raided my house in 2023. Four accused were arrested in November 2023. Those four accused are languishing in custody since then.
At this point, ED’s SPP said that such an application opposing judicial custody is not recognised in the law. Counsel for the accused submitted that the accused is ready to appear before the ED office daily and release him on the undertaking of any condition.
The court has kept pending his two applications for home-cooked food and for holy book for hearing. (ANI)
